As of the date of this version, SifG22 is a digital project without a corporate form registered in the Commercial Register. When it is incorporated as a legal entity or becomes subject to additional registration obligations, this information will be updated in this section to ensure the transparency required by article 10 of the LSSI-CE.
2. Purpose and scope of application
These Terms of use govern access to, browsing and use of the website sifg.net and its associated subdomains and services (hereinafter, "the site" or "the services"), as well as the responsibilities arising from the use of its content.
Using the site makes you a user and implies full and unreserved acceptance of each and every provision in this text, in the version published at any given time.
Certain services may be subject to their own specific terms which, where applicable, will replace, supplement or modify these general terms.
3. Acceptance and changes
By accessing the site you accept these terms. If you don't agree, you must refrain from using it. SifG22 may modify these terms at any time for legal, technical or service reasons. Changes will take effect when published, unless another date is expressly stated. It is the user's responsibility to review this page periodically.
When changes affect essential user rights or relevant contractual obligations, SifG22 will make a reasonable effort to give prominent notice before they take effect.
4. Access and registration
Access to the site is free of charge, without prejudice to the cost of connecting through the telecommunications network provided by the user's chosen provider.
Some features may require registration or the use of third-party accounts (for example, a Microsoft account to install SifG22 from the Microsoft Store). In such cases, the user is responsible for the accuracy of the data provided, keeping it up to date and safeguarding their access credentials, and undertakes to report any unauthorised use immediately.
5. Proper use of the site
The user undertakes to use the site and its content diligently, correctly and lawfully, in accordance with current legislation, morality, public order and good practice. In particular, the user undertakes not to:
- Use the site for purposes or with effects that are unlawful, harmful to the rights or interests of third parties, or that may in any way damage, disable, overload or impair the site or prevent its normal use.
- Introduce or spread viruses, malware, code that may alter systems, or any other element likely to cause damage.
- Carry out mass scraping, data mining, reverse engineering, denial-of-service attacks or unauthorised attempts to access restricted areas.
- Impersonate other users, SifG22 or any third party.
- Reproduce, copy, distribute, transform or modify the content without the owner's express authorisation where required.
- Infringe intellectual or industrial property rights, trade secrets, the rights to honour, personal and family privacy and one's own image, or any other fundamental right of third parties.
- Collect other users' personal data without their consent.
- Use the site to send unsolicited advertising (spam) or chain messages.
Failure to comply with these obligations may lead to suspension or termination of access, without prejudice to any legal action that may apply.
6. Intellectual and industrial property
Content, logos and site design
All content on the site —including, by way of example and without limitation, text, graphics, images, photographs, illustrations, interface designs, icons, source code, videos, sounds and software— is a protected work under Spanish Royal Legislative Decree 1/1996, of 12 April, approving the consolidated text of the Intellectual Property Law (hereinafter, "LPI"). This protection is automatic from creation and requires no registration or formality, in accordance with articles 1, 5 and 10 of the LPI and the Berne Convention for the Protection of Literary and Artistic Works.
The SifG22 logo, the icons and the site design as a whole are original graphic works owned by SifG22 or, where applicable, by the third parties who have authorised their use.
The reproduction, distribution, public communication, making available, transformation, translation or any other form of exploitation, in whole or in part, of this content without SifG22's prior written authorisation is expressly prohibited, except in the cases legally permitted by the LPI (quotation, parody, illustration for educational or research purposes, etc.).
The distinctive sign "SifG22"
The sign "SifG22" is used by SifG22 as the name of the project and its services. Although, as of the date shown at the top of this document, the sign is not registered as a trademark in the Spanish or European Union registers, its use in trade enjoys the following legal protections:
- Spanish Law 3/1991, of 10 January, on Unfair Competition (LCD): articles 6 (acts of confusion), 11 (acts of imitation) and 12 (unfair exploitation of another's reputation). In particular, any practice that may cause confusion with SifG22 or that involves unfairly taking advantage of the effort, prestige or reputation SifG22 has achieved in the market is prohibited.
- Paris Convention for the Protection of Industrial Property, article 6 bis, incorporated in article 6.2.d) of Spanish Law 17/2001, of 7 December, on Trademarks: enhanced protection for well-known trademarks even if they are not registered.
- Spanish Royal Legislative Decree 1/2007 (LGDCU): prohibition of misleading commercial practices that cause confusion about the business origin of services.
- Regulation (EU) 2017/1001 on the European Union trade mark and Directive (EU) 2015/2436, insofar as they apply.
Consequently, use of the name "SifG22", its logos, icons and other identifying signs —as well as any similar sign that may cause confusion— on products, services, domains, social media profiles, advertising materials, merchandise or any other medium is prohibited without SifG22's prior written consent. This prohibition is without prejudice to lawful uses permitted by applicable law, such as informative mentions, quotations or descriptive use under article 37 of Spanish Trademark Law 17/2001.
SifG22 reserves the right to bring any civil, administrative or criminal action against any unauthorised use, including actions for copyright infringement (LPI), unfair competition (LCD) and, where applicable, for a well-known trademark.
Reporting infringements
If you believe content on the site infringes third-party intellectual or industrial property rights, you can notify us at support@sifg.net, providing the identifying details of the affected rights holder, the allegedly infringed work and the URL of the content. We'll handle the claim as diligently as possible.
7. User content
If the user contributes content to the site (comments, suggestions, files, etc.), they declare and warrant that:
- They own or have the necessary authorisations for that content.
- The content does not infringe third-party rights, including intellectual property, privacy, image or honour rights.
- The content is not unlawful, offensive, defamatory, racist, xenophobic, sexist or hateful, and does not breach applicable law.
The user grants SifG22 a worldwide, non-exclusive, royalty-free licence to host, reproduce and display that content to the extent strictly necessary to provide the service. SifG22 may remove any content it considers contrary to the law or to these terms, without prior notice.
8. Links to and from the site
Links to third-party sites
The site may include links to third-party pages or services (for example, the Microsoft Store, blog.sifg.net, social networks). SifG22 does not control those sites and is not responsible for their content, availability, accuracy, quality, privacy practices or the legal terms governing them. We recommend reviewing each one's terms and policies before using them.
Links to this site
Linking to the site from third-party pages is permitted, provided the following conditions are met:
- The link must point to the home page or to specific pages, without reproducing the content within other frames (framing) or altering the presentation in any way.
- No false, inaccurate or incorrect statements may be made about SifG22, its services or content.
- The linking site may not contain unlawful content, content contrary to morality or content that infringes third-party rights.
- Linking does not imply any relationship, sponsorship or endorsement by SifG22.
9. Exclusion and limitation of liability
SifG22 will use reasonable means to keep the site's information up to date and error-free; however, it does not guarantee that the content is free of errors or permanently up to date.
To the extent permitted by applicable law, SifG22 will not be liable for any damage or loss arising from:
- Inability to access the site, failures, delays, service interruptions or transmission errors.
- The presence of viruses, malware or other harmful elements on the user's devices.
- Improper or unlawful use of the site or its content.
- Decisions made by the user based on information available on the site.
- Damage attributable to third parties, including the service providers needed for the site to operate.
Nothing in these terms limits or excludes SifG22's liability for wilful misconduct, gross negligence or any other liability that cannot be excluded or limited under mandatory law, in particular consumer protection law.
10. Service availability
SifG22 may interrupt or modify the provision of services when necessary for maintenance, updates or improvements, or for technical reasons or force majeure. We'll try to give reasonable advance notice of planned interruptions and will publish up-to-date service status information at sifg22.statuspage.io.
11. Data protection and cookies
The processing of personal data collected on the site is governed by our Privacy policy and our Cookie policy, as well as by the additional information provided in each form. All of this in compliance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).
The user may at any time exercise their rights of access, rectification, erasure, restriction, objection, portability and withdrawal of consent with SifG22 or, failing that, with the Spanish Data Protection Agency (AEPD).
12. Information for consumers
When the user acts as a consumer or user within the meaning of Spanish Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users (LGDCU), the mandatory provisions that the law recognises in their favour will apply.
In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, consumers resident in the European Union can access the European online dispute resolution platform: ec.europa.eu/consumers/odr .
Consumers may also contact the consumer authorities of their autonomous community or the consumer associations recognised in their territory.
13. Duration and termination
The website service is, in principle, provided for an indefinite period. SifG22 may terminate or suspend access to the services at any time, without prejudice to any provisions in specific terms.
Where reasonably possible, SifG22 will give prior notice of the termination or suspension of the services. Provisions that by their nature are intended to survive termination (intellectual property, disclaimer of liability, governing law and jurisdiction) will remain in force.
14. Notices
Any notice to the user may be given by publication on the site, by message to the email address provided by the user or, where applicable, through the SifG22 app. Notices to SifG22 must be sent to support@sifg.net.
15. Partial invalidity
If any provision of these terms is declared void or unenforceable, in whole or in part, by a competent authority, the remaining clauses will remain fully in force. The affected clause will, where applicable, be replaced by another valid clause that pursues the same purpose.
16. Governing law and jurisdiction
These terms are governed by Spanish law and by European Union law where applicable.
To resolve any dispute arising from access to or use of the site, the parties submit to the courts of the consumer user's place of residence, as provided for in consumer law. When the user is not a consumer, the parties, expressly waiving any other jurisdiction, submit to the courts of the service provider's place of business.
The above is without prejudice to the consumer's right to submit claims to alternative dispute resolution mechanisms or to the European online dispute resolution platform mentioned in section 12.
